1. About these Terms

These Terms of Service (“Terms”) govern your use of the SpawnerSMP Minecraft network, website, store and related services (“SpawnerSMP” or the “Service”).

SpawnerSMP is operated by Spawner SMP LTD, a private limited company registered in England and Wales under company number 17380989, with registered office at 167–169 Great Portland Street, London, England, W1W 5PF.

By using SpawnerSMP or placing an order through the SpawnerSMP store, you agree to these Terms. If you purchase something, the product description and information shown to you at checkout also form part of your agreement with us.

If you do not agree to these Terms, you must not access or use the SpawnerSMP server, website, store or related services.

Nothing in these Terms limits any consumer right that cannot lawfully be limited or excluded.

2. Accounts and Minecraft Identity

SpawnerSMP identifies players primarily through their Minecraft account and UUID. Nicknames, custom ranks and other display features do not replace that underlying identity.

You are responsible for:

keeping your Minecraft account secure and protecting any SpawnerSMP login sessions or authentication links issued to you;

ensuring you are signed in and linked to the correct Minecraft account before making a purchase; and

not allowing another person to use your account in a way that breaches these Terms or the server rules.

Where a purchase is made while a Minecraft account is linked or authenticated with the store, delivery to that linked Minecraft account will normally be treated as delivery to the account you selected for the purchase. If you linked or authenticated the wrong Minecraft account, contact us as soon as reasonably possible. We do not guarantee that an entitlement can be transferred after it has been delivered or used.

If you are not legally able to enter into a binding contract yourself, a parent or guardian must make or authorise purchases on your behalf.

3. Store Purchases and Digital Entitlements

Products sold through the SpawnerSMP store are digital products or entitlements for use within SpawnerSMP. They are not physical goods.

The price, main features and duration of a product will be displayed before purchase. Payment is processed using the payment methods offered at checkout.

A purchase does not give you ownership of SpawnerSMP, its software, servers, plugins, branding or other intellectual property. It grants only the digital entitlement described for that product, subject to these Terms.

Some products may intentionally be purchasable more than once. For example, additional Rank purchases may provide additional creation or customisation entitlements where the store description says so. A repeat purchase is therefore not automatically a duplicate or an error.

Unless the product description states otherwise, purchased entitlements are for the Minecraft account linked or selected for that purchase and may not be sold, traded for real money or transferred outside systems expressly provided by SpawnerSMP.

4. Rank, Subscriptions and Perks

SpawnerSMP may offer permanent Rank entitlements, temporary or subscription-based entitlements, cosmetics, creation balances and other benefits.

Where a product is described as a “lifetime” or permanent Rank, this means that the entitlement has no scheduled expiry while the relevant SpawnerSMP service continues to operate. It does not mean that SpawnerSMP, any particular game mode, command, perk, plugin or feature is guaranteed to exist forever.

Rank currently operates as a paid entitlement that can provide access to identity and convenience features. Individual features may be added, removed, replaced or rebalanced as SpawnerSMP develops. We will not intentionally remove the underlying paid entitlement merely to avoid providing what was purchased, but the exact implementation of its benefits may change.

If subscriptions are offered, the price, billing period, renewal terms and method of cancellation will be shown before purchase. Ending a subscription does not remove a separate permanent Rank entitlement. Features that specifically require an active subscription may stop working when that subscription ends.

Custom Rank designs, tags or other creations may remain stored after access expires, but storage alone does not grant permission to equip or use content that requires an active entitlement.

5. Custom Content and Player-Created Designs

SpawnerSMP allows eligible players to create or select certain custom display content, including ranks, nicknames, tags and similar cosmetics.

You must not use these features to impersonate SpawnerSMP staff or another person, mislead players about your authority, infringe another person’s rights, or display content prohibited by the current server rules.

We may hide, modify access to, or remove player-created content where reasonably necessary for moderation, legal compliance, technical security or enforcement of the server rules. Doing so does not necessarily remove the underlying paid Rank or other entitlement.

6. Virtual Items, Currencies and Game Data

SpawnerSMP contains virtual currencies, balances, items, spawners, vouchers, fuel, cosmetics and other game data. Unless we expressly state otherwise, these exist only within SpawnerSMP.

Virtual items and currencies:

are not legal tender, bank deposits or stored cash;

have no guaranteed real-world cash value;

cannot be redeemed for money from SpawnerSMP unless we expressly offer that facility; and

may be subject to gameplay balancing, limits, resets and anti-exploit measures.

Game values such as generation rates, drop chances, prices, upgrade requirements, limits and rewards may change as part of normal balancing and development.

We may correct balances, items or other game data where there is reasonable evidence of duplication, exploitation, technical error, unauthorised creation or another invalid source. Where practical, we will distinguish legitimate player progress from affected data.

Some keys or crates may allow you to choose between a guaranteed reward and an optional random reward. Where a guaranteed selection option is offered, the available reward can be selected directly as described in-game or in the store. Choosing the random option may make particular outcomes rarer, but a randomly obtained version of a reward does not receive additional gameplay power, functionality or value from SpawnerSMP merely because it was obtained randomly. Any applicable reward information or probabilities will be presented with the relevant crate or feature.

7. Refunds, Cancellation and Payment Disputes

Your statutory consumer rights apply to purchases from SpawnerSMP.

For digital content supplied immediately, we may ask you at checkout to expressly consent to supply beginning during the statutory cancellation period and to acknowledge that, once supply begins, you may lose the applicable right to cancel. Where the law requires a cancellation right and that right has not been validly lost, you may exercise it in accordance with applicable law.

If digital content or an entitlement is faulty, not supplied as agreed, or otherwise gives rise to a statutory remedy, nothing in these Terms prevents you from exercising that remedy.

If you believe a purchase was duplicated, made in error, not delivered correctly or affected by a technical problem, contact SpawnerSMP so that we can investigate it.

Where a payment is refunded, reversed or successfully disputed, we may remove or suspend the corresponding digital entitlement to the extent appropriate to that reversed payment. We may temporarily restrict the disputed entitlement while a payment dispute is being investigated where reasonably necessary to prevent abuse.

You should not submit a knowingly false or fraudulent payment dispute. Nothing in this section penalises you for exercising a legitimate legal, card-provider or payment-provider right.

Additional practical refund information may be provided in a separate Refund Policy. If that policy conflicts with a mandatory legal right, the mandatory legal right takes priority.

8. Server Rules, Moderation and Enforcement

Use of SpawnerSMP is also subject to the server rules made available in-game or through our official services.

Purchasing Rank or any other product does not provide immunity from those rules. We may warn, mute, restrict, suspend or ban accounts in accordance with our moderation rules and may take reasonable act

We may also warn, mute, restrict, suspend, ban or otherwise refuse access to SpawnerSMP where we reasonably consider it appropriate for moderation, safety, security, legal, operational or community-management reasons. This discretion is not limited only to conduct specifically listed in the server rules.ion against cheating, exploits, duplication, fraud, harassment, attacks on the Service or attempts to bypass restrictions.

A moderation action does not automatically create a right to a refund for a correctly supplied digital entitlement. This does not affect any refund, cancellation or other remedy you are entitled to by law.

Not every form of automation is necessarily prohibited. Where a SpawnerSMP feature expressly allows a particular behaviour, such as permitted auto-clicking within that feature, its current gameplay rules apply.

9. Changes, Balancing, Resets and Availability

SpawnerSMP is an actively developed game network. We may update game modes, plugins, commands, economies, maps, rewards, rates, limits, Rank benefits and other features for balancing, security, technical maintenance, legal compliance or continued development.

We may perform planned or emergency maintenance and do not guarantee uninterrupted or error-free availability.

World, economy or game-data resets may occasionally be necessary. We will not deliberately reset paid entitlements merely as part of an ordinary gameplay reset. If a material change directly affects something sold for money, we will consider the nature of the purchase and any rights or remedies required by applicable law.

We may discontinue a game mode, feature or the Service itself. A “lifetime” entitlement lasts for the operating lifetime of the relevant service and is not a promise that SpawnerSMP will operate indefinitely.

10. Prohibited Use

You must not:

attack, disrupt, overload or attempt unauthorised access to SpawnerSMP systems;

knowingly exploit bugs or vulnerabilities to create an unfair or unauthorised advantage;

duplicate or fraudulently create virtual items, currencies or entitlements;

use stolen payment methods or engage in payment fraud;

attempt to bypass bans, security controls, purchase restrictions or technical protections;

sell SpawnerSMP accounts, entitlements or virtual assets for real-world money where this is not expressly authorised; or

use the Service for unlawful activity.

Security research or bug reporting should be carried out only through methods authorised by SpawnerSMP and must not involve harming players, data or infrastructure.

11. Intellectual Property and Third-Party Services

SpawnerSMP’s original software, custom assets, website content, branding and other original materials are owned by or licensed to Spawner SMP LTD and are protected by applicable intellectual-property law.

Minecraft and related names, assets and services are owned by their respective rights holders. SpawnerSMP is an independent server and is not endorsed by or affiliated with Mojang Studios or Microsoft unless expressly stated otherwise.

Some parts of the Service depend on third parties, including Minecraft/Microsoft services, hosting infrastructure and payment processors. Their own terms and availability may also apply to your use of those services.

12. Liability

We do not exclude or limit liability where doing so would be unlawful, including liability that cannot be excluded under applicable consumer law.

Subject to those rights, SpawnerSMP is provided as an online game service and may experience bugs, downtime, balance changes, data issues and other technical problems. We are not responsible for losses that were not reasonably foreseeable when the relevant contract was formed, or for business losses arising from consumer use of the Service.

Nothing in these Terms excludes responsibility for fraud or fraudulent misrepresentation, death or personal injury caused by negligence, or any other liability that cannot lawfully be excluded.

13. Changes to these Terms and Termination

We may update these Terms when the Service, store, law or our business practices change. The current version will be published on the SpawnerSMP website with an updated revision date.

Where a change materially affects an existing paid entitlement, we will take reasonable steps to provide appropriate notice where required.

You may stop using SpawnerSMP at any time. We may suspend or terminate access where reasonably necessary for enforcement of these Terms, server rules, security or legal obligations.

Provisions that by their nature continue after access ends—including provisions concerning intellectual property, payment disputes and applicable liabilities—continue to apply.

14. Governing Law and Consumer Rights

These Terms are governed by the laws of England and Wales, subject to any mandatory consumer protections that apply to you based on where you live.

If you are a consumer, nothing in these Terms removes rights you have under applicable consumer law or prevents you from bringing a claim in a court that applicable law entitles you to use.
